My wife and I recently stayed at the
Moat house hotel in Oxford. I had thought the minimum tariff was bed &
breakfast. The room cost £126 for one night and was nothing special. When
we asked next morning where we could get our breakfast, we were directed to the
restaurant, no mention of cost. Come bill-paying time, we were asked for an
extra £26 for the breakfast which I thought had been included. On
complaining, I was told that I had actually booked "room only" We had also paid
£12 for a club sandwich each the night before. Rip off or what
?
Reply from the Editor:
I just phoned the Hotel pretending to make an enquiry and spoke to
Gary. I was informed that a Double room for two people is £120.00,
including breakfast, with access to all the facilities - at NO extra charge.
When I asked they said that ALL room charges include breakfast, at all times. I
think someone at the Hotel must have been on the take' when you were there.
Even their advertising at www.smoothhound.co.uk/a06778.html states "Double
/Twin Bed and Breakfast from £90.00 to £146.00 per room"
Here's the law on your case:
Price & service indications should not be misleading. If they are, it is an
offence under the Consumer Protection Act 1987 (more often brought to court
under: Section 14 of the Trade descriptions Act 1968) and should be reported to
your local Trading Standards Office. Under the Consumer Protection Act 1987 it
is a criminal offence to mislead a consumer as to the price charged or the
price to be charged. It is also an offence to fail to inform a consumer if a
price is raised after being quoted (unless this is due to a change in the VAT
rate). The maximum penalty, on summary conviction, is a fine of £5000, or
six months imprisonment, or both. You ought to immediately complain to the
hotel manager by phone quoting the riot act above, followed up by a formal
written complaint by registered mail to them & their Head Office:, Their
